Information Collected About You

Personal Information
If you choose to register for a profile or to update an existing member profile with WOOSH5 or to access certain functionality on the Services, you may be required to submit Personal Information. “Personal Information” means information that we can use to identify or contact you, such as your name, address, telephone number or email address. Some of our interactive tools and services may request you to submit health information, which would also be considered Personal Information. You are responsible for ensuring the accuracy of the Personal Information that you submit to WOOSH5. Inaccurate information will affect your experience when using the Services and tools and our ability to contact you as described in this Privacy Policy. If you are an EU data subject, we will process your health information only with your explicit consent.

If you do not provide us with the Personal Information that is required to register for and use the Services, you will not have access to the Services and we will be unable to respond to your inquiries.

Registration
Access to some WOOSH5 interactive tools and services may be limited to users who have registered. Some of our tools store your Personal Information in accordance with this Privacy Policy and any authorizations you provide at the time you submit Personal Information in order to use the tool.

Promotional Communications
At registration and at various times as you use the Services, you will be given the option of providing us with Personal Information in order to receive communications from WOOSH5 and/or directly from third parties including email and text messages.

You may at any time opt out of receiving communications from WOOSH5 or our Sponsors by sending us your name, address, e-mail and phone number to: support@woosh5.com.com. Please understand that it may take us a few days to process any opt out request and that even if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us regarding the use of our Services.

Market Research
From time to time, WOOSH5 may conduct online research surveys through email invitations, pop-up surveys and online focus groups. When participating in a survey, we may ask you to enter Personal Information. The Personal Information you submit in a survey may be used by WOOSH5 for research and measurement purposes, as described below, including measuring the effectiveness of content, advertising or programs. When our market research surveys collect Personal Information we will not knowingly accept participants who are under the age of 13. Market research surveys conducted by or on behalf of WOOSH5 will contain a link to this Privacy Policy.

Public Forums
WOOSH5 may offer public forums where users can share information and support one another. Since these forums will be open to the public, they should not be considered private.

Any information (including Personal Information) you share in any online community area including a chat room, or online discussion is by design open to the public and is not private. You should think carefully before posting any Personal Information in any public forum. What you post can be seen, disclosed to or collected by third parties subject to those third parties’ privacy practices and policies and may be used by others in ways we cannot control or predict, including to contact you for unauthorized purposes. As with any public forum on any site, the information you post may also show up in third-party search engines.

If you mistakenly post Personal Information in our public forum and would like it removed, you can send us an email asking that we remove it by contacting us at support@woosh5.com.com. In some cases, we may not be able to remove your Personal Information.

Emails You Send to WOOSH5
This Privacy Policy does not apply to information, content, business information, ideas, concepts or inventions that you send to WOOSH5 by email. If you want to keep content or business information, ideas, concepts or inventions private or proprietary, do not send them in an email to WOOSH5.

Non-Personal Information
Even if you do not register with or provide any Personal Information to WOOSH5, we may collect Non-Personal Information about your use of the Services through cookies and similar technologies, as described below. “Non-Personal Information” means information about you that does not qualify as Personal Information (as defined above). However, if you can be identified when this information is combined with other information or as required by law, we will treat such information as Personal Information. We may also acquire “Non-Personal Information” about our users from external sources. While you may use some of the functionality of WOOSH5 without registration, many of the specific tools and features on the Services require that you register with WOOSH5.

Cookies and Web Beacons
We collect Non-Personal Information about your use of the Services and your use of other web sites through the use of Cookies and Web Beacons. “Cookies” are small data files that are stored on the hard drive of the computer you use to view a web site. Every computer that accesses the Services is assigned a different cookie by WOOSH5. “Web Beacons” are graphic image files imbedded in a web page typically used to monitor activity on a web page and send back to its home server (which can belong to the host site, a network advertiser or some other third party) information from your browser, such as the IP address, the URL of the page on which the beacon is located, the type browser that is accessing the site and the ID number of any Cookies on your computer previously placed by that server.

Through Cookies we place on your browser or device, we may collect information about your online activity after you leave our Services. Just like any other usage information we collect, this information allows us to improve the Services, customize your online experience, authenticate your account, and otherwise as described in this Privacy Policy.

Upon your first connection to our website, you will be asked to confirm whether you agree to our use of Cookies and similar technologies in accordance with this Policy, and if you accept we will store them on your computer.

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioural advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Services and after you leave our Services.

Third parties under contract with WOOSH5 may use Cookies or Web Beacons to collect Non-Personal Information about your usage of the Services. These third party advertising service providers may use this information, on our behalf and pursuant to our instructions, to help WOOSH5 deliver advertising on the Services as well as on other sites on the Internet based on your browsing activity on our Services. WOOSH5 may further tailor the advertising on these third party sites based on additional Non-Personal Information to the extent known by WOOSH5 or these third parties.

Mobile Device Applications and Mobile Optimized Sites
When you download and install a WOOSH5 mobile application (“App”) onto your mobile device we will assign a random number to your App installation. This number cannot be used to identify you personally, and we cannot identify you personally unless you choose to become a registered user of the App. We use this random number in a manner similar to our use of Cookies as described in this Privacy Policy. Unlike Cookies, the random number is assigned to your installation of the App itself and not a browser, because the App does not work through your browser. Therefore the random number cannot be removed through settings. If you do not want us to use the random number for the purposes for which we use Cookies, please do not use our App. Because some of the content on our App directs your mobile device to our Services you will be exposed to the cookies that we use and to third party cookies that may be contained in advertisements that we do not control and will be unable to delete any of these cookies with your mobile device. Therefore, if you do not want to use these cookies when you use your mobile device you should not use our App and you should set your mobile device to reject cookies when you use our mobile optimized sites.

Information Collected by Third Parties Not Acting on WOOSH5’s Behalf
We work with third parties to display advertising that reflects the interests and preferences of our user community. Sponsors or advertisers on the Services may use their own Cookies, Web Beacons or other online tracking technologies in the banner advertisements served on the Services and in emails, special promotions or newsletters we send you. Their advertisements may be displayed on the Services or on other sites that you visit after you visit the Services. Some advertisers use companies other than WOOSH5 to serve their ads and to monitor users' responses to ads, and these companies ("Ad Servers") may also collect Non-Personal Information through the use of Cookies or Web Beacons on the Services.

We do not control how third parties use Cookies or Web Beacons or how they manage the Non-Personal Information they gather through the use of these technologies on the Services. However, our Advertising Policy prohibits sponsors, advertisers and Ad Servers who collect cookie or web beacon information through the Services from collecting any Personal Information from the Services without your consent. Our Advertising Policy also prohibits advertisers from linking any Non-Personal Information collected by them on the Services to Personal Information they or others collect in other ways or from other sites except as may be described in connection with a particular program.

  • conduct research and measurement activities, including those described below, or
  • undertake additional activities in accordance with your authorization, for which we provide specific notice at the time of collection of your Personal Information.

WOOSH5 may combine Personal and Non-Personal Information collected by WOOSH5 about you, and may combine this information with information from external sources.

If you are located in the European Economic Area (EEA), if you give us your consent we will transfer Your Personal Information to our servers in the United States to provide you with our Services. The United States may have data protection laws and privacy protections that differ from those in the country in which you are located. Where we transfer your Personal Information out of the EEA we will take steps to ensure that your privacy rights continue to be protected. If you consent but later change your mind and no longer wish us to transfer your Personal Information to the United States, please contact us at support@woosh5.com.com and we will ensure your Personal Information is no longer transferred to the United States. If you withdraw your consent, this will not affect the lawfulness of processing based on consent before its withdrawal.

Research and Measurement activities
Information that WOOSH5 collects about you may be combined by WOOSH5 with other information available to WOOSH5 through third parties for research and measurement purposes, including measuring the effectiveness of content, advertising or programs. This information from other sources may include age, gender, demographic, geographic, personal interests, product purchase activity or other information. We may report aggregate information, which is not able to be identified back to an individual user of the Services, to our current or prospective advertisers and other business partners. We do not sell or share any Personal Information with any third parties, except as described below.

With Whom Do We Share Your Information?
Except as described in this Privacy Policy or as specifically agreed to by you, WOOSH5 will not disclose any Personal Information it gathers from you through the Services. We may only release Personal Information to third parties: (1) to comply with legal requirements such as a law, regulation, search warrant, subpoena or court order; (2) in special cases, such as in response to a physical threat to you or others including a reasonable determination of imminent risk of suicide, to protect property or defend or assert legal rights; or (3) as described below.

In the event of a corporate change in control resulting from, for example, a sale to, or merger with, another entity, or in the event of a sale of assets or a bankruptcy, WOOSH5 reserves the right to share and/or transfer your Personal Information in connection with the evaluation of and entry into such transactions.

If you register for an account sponsored by an insurer or your employer (“Sponsor”), we may share certain of your Personal Information and information about your usage of the Services with your Sponsor or your Sponsor’s third party administrators (e.g., incentives vendors, wellness administrators, etc.) for payment, operational and/or program evaluation purposes.

Disclosures to WOOSH5 Operations and Maintenance Contractors
WOOSH5 contractors sometimes have limited access to your Personal and Non-Personal Information in the course of providing products or services to WOOSH5. These contractors include vendors and suppliers that provide us with technology, services, data analysis, research, advertising and marketing assistance and/or content for the operation and maintenance of the Services. We ask our operations and maintenance contractors to agree not to use or disclose your Personal or Non-Personal Information for any purpose other than providing the limited service or function for WOOSH5 or as would or as required by law.

Disclosures to Third Party Web Sites
Certain content, services and advertisements offered to you through the Services are served on, or contain links to, web sites hosted, controlled and operated by a company other than WOOSH5 ("Third Party Web Sites"). WOOSH5 does not disclose your Personal Information to these Third Party Web Sites without your consent, but you should be aware that any information you disclose to the other web sites once you access these other web sites is not subject to the privacy practices described in this Privacy Policy. WOOSH5 does not endorse and is not responsible for the privacy practices of these Third Party Web Sites. You should review the privacy policy posted on the other web site to understand how that Third Party Web Site collects and uses your Personal Information. WOOSH5 makes an effort to make it obvious to you when you leave our website and enter a Third Party Web Site, either by requiring you to click on a link or by notifying you on the Services before you visit the Third Party Web Site. In addition, if you see a phrase such as "Powered by" or "in association with" followed by the name of a company other than WOOSH5, then you are on a web site hosted by a company other than WOOSH5.

Information that’s been de-identified
We may de-identify your Personal Information so that you are not identified as an individual, and use such information for our business purposes, including providing that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we do not disclose aggregate usage or de-identified information to a partner (or allow a partner to collect such information) in a manner that would identify you. For EU data subjects, this use of your Personal Information is necessary for our legitimate interests in conducting and managing our business, understanding how the Services are being used by you and to improve your experience on them.

How Do We Secure and Retain Your Information?
We take reasonable security measures to protect the security of your Personal Information. Despite WOOSH5's efforts to protect your Personal Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

The security of your Personal Information is important to us. When you enter Personal Information (including health information in various tools through our Services), we encrypt the transmission of that information or use SSL connections (Secure Socket Layer) technology.

We will retain your Personal Information as long as your account is active or needed to provide you with our Services. At any time you can remove your Personal Information or instruct us to remove it. We will also retain your Personal Information as necessary to comply with legal obligations, resolve disputes and enforce our agreements.

We are committed to protecting the privacy of children. The Services are not designed or intended to attract anyone under the age of 13. The Services do not collect or solicit Personal Information from any person we actually know is under the age of 13. If you are under 13, please do not attempt to register for the Services or send any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at support@woosh5.com.com.
